DREW Harris has defended garda handling of the Evan Fitzgerald case after the gunman killed himself with a gun in a Carlow Shopping Centre after being arrested for buying guns from undercover cops.
The Garda Commissioner has warned that “people will see why this was entirely proportionate” when others linked to the case are dealt with in the courts.
Evan Fitzgerald, 22, was arrested last year as part of an investigation into the sale of weapons on the dark net.
Undercover gardai arranged to meet Fitzgerald and two others and carried out a “controlled delivery” where they provided decommissioned guns from garda stores to the three men.
Gardai then swooped on the men and arrested them over firearms charges.
In the run up to his court date, Fitzgerald went on to steal a shotgun from a neighbour and went to Fairgreen Shopping Centre in Carlow where fired a number of shots in the air before turning the weapon on himself and taking his life.
The 22-year-old has been described as a “vulnerable” person who was obsessed with guns.
Former Justice Minister Michael McDowell raised the case in the Seanad this week and accused gardai of entrapment.
Garda Commissioner Drew Harris was this afternoon quizzed about the case in the Public Accounts Committee where he launched a staunch defence of the actions of the undercover gardai.
He said: “I do believe the operation was necessary.
“I’ve reported to the Minister on the operation and a file was submitted to the DPP as well and they accepted that file and there were charges preferred in respect of those firearms but also other items including explosives.
“I do think in terms of public safety and the danger there was to the public that that operation was fully warranted and proportional.”
Pressed on the issue by Labour TD Eoghan Kenny, the Commissioner claimed details that will emerge from the courts on the case will justify the gardai’s actions.
He said: “This matter is still before the courts.
“There are still two individuals who are before the courts and I don’t want to elaborate further but I think once more details emerge through the courts process people will then see for themselves actually why this operation was entirely proportional.”
The Commissioner told Fine Gael’s James Geoghegan that he noted Senator McDowell’s entrapment accusations and has referred them to the Ombudsman due to the seriousness of the charge made in the Seanad.
The Commissioner said that there was some incorrect information circulating about the case.
He said the guns used during the “controlled delivery” operation were taken back by gardai.
He clarified that the gun Evan Fitzgerald took to the Carlow shopping centre had been stolen during a burglary.
Gardai also later found another gun and an imitation gun as part of searches carried out after the Carlow shooting and they were unaware of how Fitzgerald obtained these guns.

The Sweden international, also a target for Manchester United and Liverpool, has long been touted as Arsenal’s second choice behind Sesko.
Some Arsenal fans are growing impatient with the club for not moving as swiftly in the summer market as rivals Liverpool, Manchester City and Chelsea.
And there is no doubt that boss Mikel Arteta himself would want to sign a centre forward before the squad fly to Singapore for their pre-season tour on July 19.
But there is a distinct possibility that another frontman – neither Sesko nor Gyokeres – will be on the plane.

Berta was sporting director at Atletico Madrid when Alvarez joined the club from City last year.
Despite a good season in Madrid, Alvarez is keen to return to the Premier League and his experience of English football makes him a really attractive option for Arsenal – and other clubs, including Liverpool.
Atletico would want more than the £82m they paid for the World Cup winner.
But Arsenal might consider that a price worth paying for a player who is still only 25.
Ekitike is also an intriguing option. Some stats gurus reckon the France international, 23, would be the best buy for a top Premier League club this summer.

ARSENAL’S never-ending hunt for a world-class striker is in turmoil as deals for Benjamin Sesko and Viktor Gyokeres stall.
The Gunners were confident of doing their business quickly this summer after months of preparation by boss Mikel Arteta and new sporting director Andrea Berta.
But inflated asking prices and broken gentlemen’s agreements have derailed those plans and left Arsenal frustrated.
Sesko believed he would be allowed to leave RB Leipzig for around £60million, while SunSport understands Gyokeres was told £59m would be enough to seal his own exit.
But those price-tags have gone up, leaving Arsenal debating whether they represent value for money.
While the players’ camps are also growing restless, knowing the Gunners can only sign one of them.
So what next? Will Arsenal keep waiting in the hope of fees eventually going down? Or turn to other targets, like Frankfurt’s Hugo Ekitike?
Whatever they decide, with pre-season looming and the fixtures already out, Arteta will be desperate for them to move quickly to avoid another nearly season.
Unlike Leipzig with Sesko, current club Eintracht Frankfurt are under no pressure to cash in on Ekitike.
They will play Champions League football again next season and sold Omar Marmoush to Manchester City in January in a deal worth up to £64m.
So Eintracht can hold out for the £85m that they want for Ekitike, especially with Liverpool, Manchester United and other clubs all prepared to rival Arsenal for his signature.
Which means that if Arsenal bide their time a bit and can get Sesko for less, he could still be their man, the striker given the task of turning Arteta’s team of nearly men into winners.
But despite all the talk about Sesko and Gyokeres, the Gunners’ top target may have been someone else entirely all along.
A BURST water pipe has left a part of the major Irish town and beyond with no running water in its homes and businesses.
Tipperary Town and the surrounding area has been left without water after the water main pipe burst in Pearse Park.
Uisce Eireann revealed that the repairs on the burst water pipe are underway, but residents and businesses are warned that it may cause supply disruption throughout the day.
It was reported that the repairs will be completed by 2pm, but may take up to 5pm.
The alert for the incident said: “Repairs to a burst water main may cause supply disruptions to Tipperary Town and surrounding areas in Co Tipperary.
“Works are now scheduled to take place until 2pm on 26 June.
“We recommend that you allow three to four hours after the estimated restoration time for your supply to fully return.”
And it is also affecting Bansha, Cloonfinglass and the surrounding areas.
It is currently unknown how many customers are impacted by the unexpected outage.
The Irish Independent reported that the town’s Community Services Centre was forced to shut its doors as a result of the water outage.
However, the Meals on Wheels service remains in operation.
Tipperary’s Citizens’ Information and the INTREO office will also remain closed.
Talking to social media, the local Gable Coffee Bar cafe revealed they were forced to stop serving coffee due to the disruption to the water supply, but they remain open to serving sweet treats and snacks.
However, an hour after their announcement, their water supply was back up and running and the store was able to provide their loyal customers with their coffee fix of the day.
Near the affected Tipperary Town, residents living in Oola, Newtown, Pallasgreen, Cluggin and surrounding areas in Co Limerick were also impacted by a separate burst water main.
The national water organisation reported that work is underway to restore the water supply to the affected residents.
It is expected that the repairs will be completed by 3:30pm this afternoon.
As recommended for the previous incident, residents are encouraged to allow three to four hours after the estimated restoration time for their supply to return fully.
Those who are affected by the burst water pipes are urged to keep tabs on their official website for updates in their area.
It will provide information about the repairs, including the estimated time of completion and advice.

AN URGENT warning has been issued over a life jacket sold in Ireland that poses a life-threatening risk.
Decathlon is carrying out a recall on their TRIBORD Lifejacket LJ150N Harness.
The Competition and Consumer Protection Commission issued the recalls for the lifejacket after discovering the product presents a risk of drowning.
It was discovered that during use and after repeated impacts on the product, it could pierce, which results in reduced buoyancy and a risk of drowning.
The brand is TRIBORD. The model number is 8801769. The bar code is 3608390327027. The article/item code is 4855900.
The recall applies to grey and black versions as well.
And there are approximately 11 affected products in the Republic of Ireland.
The product was reported to be sold from March 1, 2024.
The CCPC has urged customers to “stop using the product immediately”.
Customers can return their affected product to their nearest Decathlon store to receive a full refund.
Remedies are also available for customers if they prefer a replacement over a full refund.
For those who have purchased the product online, they are encouraged to contact Decathlon’s Customer Relations Centre via email at help.ireland@decathlon.com.
And those who have any questions or require more information about the recall can also contact them.
A spokesperson for Decathlon said: “We appreciate your understanding and apologise for any inconvenience caused.”
Meanwhile, Lidl Ireland issued a recall alert over the Tower 2L Compact Manual Air Fryer/2L Vortx Air Fryer following the discovery of an “overheating” manufacturing defect.
A number of Air Fryers sold to customers could overheat, presenting a risk of fire.
The issue has been identified within batches that were sold between January 2024 and April 2024 in Lidl stores across the country.
Lidl chiefs said: “Tower are recalling the above 2L Compact Manual Air Fryer / 2L Vortx Air Fryer with serial number T17087 due to risk of overheating which may cause a risk of fire.
“Other Tower products are affected by this recall but only the one listed above was sold in Lidl Ireland & Northern Ireland stores.
“If you have purchased the above product please stop using it.”
